Canadian Investors Losing Money with American Financial Advisors

Are you a Canadian investor who has suffered investment losses with an American financial advisor or stockbroker?  Many Canadian investors use the services of financial advisors or securities brokers who are licensed in the United States, often through FINRA (the Financial Industry Regulatory Authority), which is similar to the Canadian Securities Administrators. Under FINRA rules, when a financial advisor recommends an investment to his or her client, he or she has to ensure that the investment is suitable for that client given their risk tolerance, investment objectives, age, financial resources (like net worth and income), and so on.  Moreover, advisors must adequately explain all important or material risks of an investment to their clients before the investment is made.

If your financial advisor or securities broker made an unsuitable recommendation for you, they may be liable for your losses.  Moreover, if you have been the victim of your advisor’s fraud or theft, the brokerage firm that the broker worked for may also be liable.

In the U.S., securities brokerage firms have a responsibility to adequately supervise all representatives who are registered through their firm.  Brokerage firms also must take steps to ensure that their financial advisors follow all securities rules and regulations, as well as internal firm policies.  When brokerage firms fail to adequately supervise their registered representatives, they may be liable for investment losses sustained by customers.  Claims against U.S. securities firms may be brought in FINRA arbitration to recover these losses.
