Have you lost money with financial advisor Maria Fan of New York, New York?  We are investigating allegations made by FINRA, the Financial Industry Regulatory Authority, against Maria Fan. FINRA suspended Fan for 60 days regarding allegations that she made exaggerated claims to a customer about stocks.

 

According to FINRA’s allegations, Maria Fan was alleged to have used a non-firm issued smartphone to send text messages to customers.  In the texts, she was alleged to have made exaggerated claims regarding certain stocks.  She told one customer that “I can make you $1000 in a day if you give me $2000 tomorrow with GPRO [GoPro, Inc.]”.  She told another that “ADHD [Alcobra Ltd.] will go up to $40 in two weeks”.  To settle these allegations, Fan agreed to a 60-day suspension and a deferred fine of $7,500.

 

Maria Fan was a financial advisor and registered representative of Aegis Capital Corp. from March 2014 to August 2015.  She also was affiliated with Wilmington Capital Securities from July 2015 to January 2016; and with HSBC Securities from April 2013 to August 2013.  She worked at branch offices in New York, New York.  According to FINRA’s Brokercheck, Fan is the subject of three customer complaints, alleging unsuitable investment recommendations and fraud.

 

Brokerage firms like Aegis Capital Corp. have a responsibility to adequately supervise all representatives who are registered through their firm.  Brokerage firms also must take steps to ensure that their financial advisors follow all securities rules and regulations, as well as internal firm policies.  When brokerage firms fail to adequately supervise their registered representatives, they may be liable for investment losses sustained by customers.
