Have you invested in the California Proton Treatment Center LLC? The California Proton Treatment Center is a proton therapy cancer treatment center in San Diego, California. Several years ago, the California Proton Treatment Center raised capital by issuing securities to investors.
In early January 2017, the California Proton Treatment Center sent a letter to investors. In the letter, the Proton Center disclosed that it is having trouble meeting its obligations with a number of lenders. The letter also stated that there were several defaults of these loans, followed by a default under a forbearance agreement with lenders. In simple terms, the California Proton Treatment Center’s finances are in bad shape. Moreover, investors who invested money with the California Proton Treatment Center are likely to face substantial losses with their investment.
When securities brokerage firms recommend investments to investors, they have a duty to ensure that the investment is suitable for the investor. The brokerage firm must also perform reasonable research (or due diligence) on the company, so that the firm can adequately disclose the risks of investing in such company. Some brokerage firms who sold investments in the California Proton Treatment Center may not have done the proper due diligence and therefore may not have disclosed all the relevant risks of investing in the proton center.
According to a Form D filed with the Securities and Exchange Commission (SEC), two firms received compensation for selling interests in the California Proton Treatment Center: 1) WFG Investments; and 2) Cravens Wealth Advisors, both of which are located in Dallas, Texas.
