Sean Kelly, formerly with Center Street Securities and Capital Financial, Subject of SEC Complaint
Have you lost money investing with Sean Kelly from Marietta, Georgia? We are investigating allegations made by the Securities and Exchange Commission (SEC) against Sean Joseph Kelly, formerly with Center Street Securities. Kelly was the subject of a complaint by the SEC, who seeks civil penalties against Kelly and seeks to stop an alleged ongoing fraud. The SEC brought this complaint against Kelly, alleging that Kelly raised at least $1 million from 12 investors under the guise of his “Lion’s Share” businesses.
The SEC alleged that Sean Kelly operated several entities including Lions Share & Associates, Lionsshare Tax Services, and Lions Share Financial of East Cobb, Inc. He raised money, telling investors that he would invest the money in CDs, private placements, and real estate. Instead, the SEC alleges that he used the money to buy Super Bowl tickets, take luxury vacations, and make cash withdrawals. The SEC alleges that he has engaged in this fraud scheme, since 2014, when he was affiliated with Capital Financial Services.
Sean Kelly was a representative of Center Street Securities from August 2017 to October 2018. He also worked with Capital Financial Services from August 2012 to August 2017. He worked at a branch office in Marietta, Georgia. Kelly had also filed for bankruptcy twice, in 2009 and 2014.
Brokerage firms like Center Street Securities and Capital Financial Services have a responsibility to adequately supervise all representatives who are registered through their firm. Brokerage firms also must take steps to ensure that their financial advisors follow all securities rules and regulations, as well as internal firm policies. When brokerage firms fail to adequately supervise their registered representatives, they may be liable for investment losses sustained by customers.
