Timothy Ayre, Formerly with Spencer Edwards, Subject of FINRA Complaint

Have you invested with a company called Rocky Mountain Ayre, Inc.?  Our investment fraud law firm is investigating claims made against financial advisors and brokerage firms who recommended that investors invest in Rocky Mountain Ayre.

FINRA (the Financial Industry Regulatory Authority) recently brought a regulatory action against Timothy Ayre of Agawam, MA who was previously affiliated with Spencer Edwards. FINRA alleged that Timothy Ayre defrauded investors by authoring and disseminating disclosures and financial statements about Rocky Mountain Ayre that contained material misrepresentations.

As an example, FINRA alleged that Ayre and Rocky Mountain Ayre made misrepresentations about HempCoin, a purported cryptocurrency.  Ayre failed to register HempCoin with the Securities and Exchange Commission (SEC).  FINRA alleged that Ayre offered and distributed HempCoin in 2016 with the hopes that demand would drive the value up of an otherwise worthless company.

Timothy Ayre was a registered representative of Spencer Edwards from May 2013 to March 2016.  He worked at a branch office in Agawam, Massachusetts.  Ayre was later terminated by Spencer Edwards related to this conduct.

When brokers and brokerage firms recommend a particular investment to a customer, they must perform adequate due diligence on the company before recommending the invest, so that they can adequately disclose all the risks of investing to the investor.  If the broker or firm fails to do so, it may be liable for the investor’s losses.
