Robert H. Potter and Cambria Capital, Inc.

 

Have you lost money with financial advisor Robert Potter of Salt Lake City, Utah?  We are investigating allegations made by FINRA, the Financial Industry Regulatory Authority, against Robert H. Potter. FINRA barred Potter from the securities industry after he failed to respond to a FINRA investigation.  FINRA was investigating Potter regarding allegations that he commingled his customers’ funds along with personal funds.

 

Robert Potter was also recently the subject of a regulatory action by the Utah Division of Securities.  The Utah Division of Securities brought a complaint, alleging that Potter had borrowed over $1.3 million from customers, which is generally a violation of a securities rules and regulations, and often violates a brokerage firm’s internal policies.

 

Robert Potter was a financial advisor and registered representative of Cambria Capital LLC from August 2011 to August 2015.  He worked at a branch office in Salt Lake City, Utah.  Potter has also been the subject of at least three customer complaints, as well as another regulatory investigation by the National Futures Association.  Additionally, Rob Potter was fired by Cambria Capital, which discloses on his BrokerCheck Report that Potter had allegedly opened a:

 

COMMODITIES/FUTURES ACCOUNT IN THE NAME OF THE INDIVIDUAL AND DEPOSIT FUNDS FOR INVESTMENT IN OIL FUTURES CONTRACT(S). THE INDIVIDUAL ALLEGES NO ACCOUNT WAS EVER ESTABLISHED AND QUESTIONS THE VALIDITY OF ANY TRANSACTIONS DESPITE REPRESENTATIONS FROM MR. POTTER THAT THE CUSTOMER HAD PURCHASED A CONTRACT FOR OIL FUTURES AND PROVIDED A VALUATION OF THE POSITION.

 

Brokerage firms like Cambria Capital have a responsibility to adequately supervise all representatives who are registered through their firm.  Brokerage firms also must take steps to ensure that their financial advisors follow all securities rules and regulations, as well as internal firm policies.  When brokerage firms fail to adequately supervise their registered representatives, they may be liable for investment losses sustained by customers.
