The SEC filed a complaint in September 2013, alleging that Chiappone, Guzzetti, Lex, Livingston, Mayer, and Rabinovich failed to due adequate due diligence on the private placement securities that they sold. According to their BrokerCheck reports, in February 2015, each was suspended from the securities industry for 12 months and fined for their roles in selling these private placements.
However, Chiappone has filed an appeal regarding his suspension, and the 12-month suspension does not take effect while the appeal is pending. During this time, Chiappone may still sell securities.
