Losses with George Bussanich or Metropolitan Ambulatory Surgical Center (MASC)?

The SEC alleges that MASC was owned by George Bussanich’s father.  It further alleged that Bussanich made materially misleading statements when recommending the promissory notes to investors.  Moreover, the promissory notes were not registered, and the company commingled and misused investor funds.

George Bussanich, Jr. was a registered representative and financial advisor of Kovack Securities from 2006 to December 2011. He worked at a branch office in Cliffside Park, New Jersey.

Brokerage firms like Kovack Securities have a responsibility to adequately supervise all representatives who are registered through their firm.  Brokerage firms also must take steps to ensure that their financial advisors follow all securities rules and regulations, as well as internal firm policies.  When brokerage firms fail to adequately supervise their registered representatives, they may be liable for investment losses sustained by customers.
